I haven't received it via snail mail yet, but I did contact AndresPartners via email, asking for my status. They sent me all the documents in electronic form and confirmed I should receive the letter shortly.

I think it's worth asking whether you're on the list.

Finally received the insolvency proceedings from Andres Partner today by mail. Now I'll have to dig into it and probably ask for advises to ChatGPT :/
If some of you would be kind enough to help with some initial questions:
- The "Filing of Claims" form has been sent to me in English but it says that "the application must be submitted in German" so I believe that it means any data included and surrounded that form ? Or should I obtain a German version of that form ?
- On that matter, is there an online PDF version of that form somewhere that I could fill using Adobe Acrobat or should I use my most precise pen ? :o

1. I fill out everything with English.
2. Some fields are not enough, such as bank account details. So I prepare a more detailed version in ENglish.
3. I send both the form and the detailed version to info@andrespartner.de and they said they have included me to the list.

I was informed by AndresPartners that it's a mistake in the document and that actually both German and English are allowed. That also aligns with the fact that you (and me too) received only the English version of the form.

Of course, it's always better to ask at the source.

I am wondering what people who issued some refunds are doing. Situation - Digital River issued credit notes documenting sales. Those credit notes were not paid. In the meantime we issued some refunds. What claims should be really submitted? Original unpaid credit notes? Balance?

I discussed this with my lawyer, and I ended up filing only the unpaid credit notes (a single one in my case).

That's mainly because I disputed their invoices for the refunds, because (a) they did not include a detailed list of transactions and (b) they charged me platform and support fees even though I terminated my contract before MSA 6.3 came into effect.

If they find that I owe them money for the refunds, it can still be offset against my claim later (§ 94 Insolvezordnung).

I haven't read this thread for a while, but I have a question.

How can we guarantee that our personal information has been deleted?
We don't want the old server hardware to be sold to a random buyer, without being wiped first.
