Also received report for October (there were 2 sales, not everything yet were purged). I noticed that amount from "Carry-over from last summary" disappeared from August report, and September and October reports look like they paid out money for July and August! Nothing received, of course.

I have not been paid since July.
I have received statements for each of the months in question and none of them showed any "Carry-Over"

Their last invoice/credit note a few days ago still has Scheidweilerstr 4 in cologne as the address.

Their registered office (in Handelsregister) has changed to Wiesenhüttenstraße 11, 60329 Frankfurt am Main, as of 04 November 2024.

But that is only a external company receiving, scanning and forwarding their mail for them ("TMF Group").

However this is actually everything you need to legally operate a GmbH in Germany - a domestic address where you are able to receive official letters.

So basically, they have turned Digital River GmbH into a shell corporation.

Same here:
- Received payment report for October today (too late)
- They sent an email to me that they would have paid the overdue September yesterday
- But no money arrived

I have:
- Finished KYC twice (2023 and July 2024)
- Sent 4 dunning letters to their different addresses (Mahnung)
- Involved a lawyer
- Collected lots of evidence for a lawsuit

Did your Mahnung letters just end up in the solution centre? Or did DR actually respond to anything?

Mine was scanned, translated and turned into a support ticket. But no response whatsoever, other than the usual "we have forwarded this to our internal department" blahblah.

You need to send a normal 'Mahnung' before you can take further legal steps. You should send it as an 'Einschreiben with Rückschein', so you can proof that they received it. The next step is a 'gerichtlicher Mahnbescheid' at the 'Mahngericht Coburg'. This means they need to go to court if they don't pay.

So if you want to take them to court in Germany you should have quit your contract befor January the 6th. Otherwise you will have to travel to the USA.

The next step is a 'gerichtlicher Mahnbescheid' at the 'Mahngericht Coburg'. This means they need to go to court if they don't pay.

They can also neither pay nor go to court, simply ignoring the Mahnbescheid. Next you can get a Vollstreckungsbescheid which says you officially deserve to get paid by them (yay!). They'll still ignore it, so now you'll send a Gerichtsvollzieher, who will however only find a letterbox at their address. After that, finally *you* can take them to court, which will hopefully be able to get hold of your money by force (that is, if it's not been converted to a huge pile of dollar bills in a bathtub somewhere on the Caymans).

So if you want to take them to court in Germany you should have quit your contract befor January the 6th. Otherwise you will have to travel to the USA.

As an alternative, appealing the upcoming changes in written form should be sufficient. This should be better for those who need access to their account at least for some time to come.

Money is still not credited, lol. According to our past record, the money would arrive in the account with 24 hours after the monthly payment notification email.

Received the payment email, but no money. It should have been credited to our business account long ago. Let's not kid ourselves, the money will never come. You can all cancel myCommerce, maybe you'll have another chance after the 180-day blocking period. But don't get your hopes up too much. It's over!

The statements in the CP seem to work again, which is a positive. Haven't received any payment yet.
